These Terms of Service ("Terms") govern your access to and use of the PackProof platform and services provided by PackProof Pty Ltd ("PackProof," "we," "us," or "our").
By accessing or using PackProof, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services. We may modify these Terms at any time, and continued use constitutes acceptance of modified Terms.
PackProof provides a cloud-based platform for capturing, storing, and retrieving photo and video evidence of packing events. The service includes mobile applications, web dashboard, API access, and related features as described in your subscription plan.
To use PackProof, you must:
You are responsible for all activity under your account. Notify us immediately of any unauthorized access.
4.1 Fees: You agree to pay all fees associated with your subscription plan. Fees are billed in advance on a monthly or annual basis.
4.2 Payment: You authorize us to charge your payment method for all fees. If payment fails, we may suspend or terminate your access.
4.3 Price Changes: We may change pricing with 30 days' notice. New prices apply at your next billing cycle.
4.4 Refunds: Fees are non-refundable except as required by law or explicitly stated in these Terms.
Free trials provide full access to paid features for a limited time. If you do not cancel before the trial ends, you will be charged for the selected subscription plan. Cancel anytime during the trial to avoid charges.
You agree not to:
7.1 Ownership: You retain all rights to evidence and data you upload to PackProof ("Your Content"). You grant us a limited license to store, process, and display Your Content solely to provide the service.
7.2 Responsibility: You are solely responsible for Your Content and must ensure you have all necessary rights and permissions to upload it.
7.3 Backup: While we implement redundant storage, you are responsible for maintaining your own backups of critical data.
PackProof and its content (excluding Your Content) are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the service. All rights not expressly granted are reserved.
We strive for 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for downtime, data loss, or service interruptions.
10.1 By You: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period.
10.2 By Us: We may suspend or terminate your access if you violate these Terms, fail to pay fees, or engage in prohibited conduct. We will provide notice when possible.
10.3 Effect of Termination: Upon termination, your access to the service ends. Your Content remains accessible for 90 days for export, after which it is permanently deleted.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PACKPROOF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless PackProof from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the service, Your Content, or violation of these Terms.
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be resolved in the courts of New South Wales. You agree to arbitration for disputes under AUD $50,000.
15.1 Entire Agreement: These Terms constitute the entire agreement between you and PackProof regarding the service.
15.2 Severability: If any provision is found invalid, the remaining provisions remain in effect.
15.3 Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
15.4 Assignment: You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.
